Hi, Does anyone know or know where I could find out the legal rules motor dealers have to abide by. My questions are how long does a motor dealer have to own a vehicle before they can sell it as a private sale? Does a motor dealer trade under a business name or under their own name?

If you've got a problem with a car you've already bought, then Trading Standards are the people to speak to.
If you're looking at a car that is being sold by a dealer, but they are saying its their private car, then potentially you have no simple redress if things arent as they should be as it is not a retail sale. Any terms such as 'Trade Sale' are to be taken as a warning not to proceed with the purchase unless you know exactly what you are doing.
Of course, car dealers are allowed to own their own cars, if its registered in their name that would support this as I dont know any dealers that want to add owners to a log book.

I spent 20 years in the finance industry dealing with the motor trade.
If a dealer sells you car and hands you an invoice as a bill of sale then it is a trade sale. The dealer has to warrant that car for 12 months regardless of the fact that they gave you 3 or 6months or none at all. This is a law laid down by the EC. You get an implied warranty when you purchase. The only way round that for a dealer is to sell the car as scrap and for that dealer to write on the invoice sold as scrap customer to up lift vehicle from site.
One important point to bear in mind is that for the first 6 months the dealer has to prove that the vehicle was OK at the point of purchase. For the second 6 months you have to prove that the vehicle was not.
At the end of the day you can not beat having a new MOT. With the new printed MOTs it is imposible to get a moody MOT. If the MOT station falsifies the MOT they will be heavily fined and will lose the right to be an MOT station. If they keep missing things that should be spotted again they will loose the station. |
